International NDA

Hey members
A very happy new year to each and all of you.
Is there such a thing as an international Non-disclosure agreement? I'm planning a conference call with a digital marketeer in another country and would like her to sign a NDA since I'll be discussing confidential information. How can I protect myself in the best way possible?

An NDA is an NDA it doesn't matter whether you are discussing something with someone in the UK or internationally.

Yes you can have an NDA drawn up but unless you have the finances to pursue things legally (could be expensive internationally) they are not particularly useful.

Far better to ensure you have a patent for a product and a trademark for your brand.

You can't. You can only give yourself the illusion of protection.

NDAs are pretty worthless as a means of getting protection. If the other party breaks the NDA the chances are you won't know about it, or will hear about it when it's too late. Even if you do know about the breach you can't do jack about it especially if it's in another country. Even if it's in the UK there's almost nothing you can do (apart from spending £50K on taking them to court).

My advice: Don't disclose anything unless you are prepared to lose it.

I've heard this before but I always wonder .. this might not be the best example financial wise but Michael Jackson worked with a ton of artists and recorded hundreds of songs that never saw the daylight, has tons of footage that was recorded and there were literally thousands of people. How come they don't speak? Is there really no way of getting them to sign something that can be enforced in a court anywhere in the world?
