Intellectual Property Articles - Any Suggestions?

We have a monthly newsletter where we try to cover intellectual property (IP) issues that might be of interest to the subscribers.

IP can be quite a dry subject, so many of the developments in law are unlikely to be of general interest!

An article on the 'Top 5 IP Mistakes' proved to be very popular, and this got us thinking that perhaps the best way to come up with ideas for articles is to ask the public.

So...this post is to invite the UKBF members to suggest any articles on IP that they would like to read.

All suggestions will be gratefully received.

Cheers

David

Interview the IPO on their new revamped IP mediation service. I can put you in touch with the head guy if you want to interview him.

Another subject of practical use would be one on the complex and fast developing/changing subject of IP breach through using trademarks in metadata/Adwords etc.

Also approach of eBay/Amazon etc on trademark abuse in product listings.

Thanks very much for your suggestions - an interview might indeed be interesting. We'll have a think about the interviewee and might take you up on your offer re the IPO contact.

eBay & Amazon issues are also a good suggestion - we often get enquiries about this.

As to AdWords - we covered the Interflora case last month:

  • When to use a confidentiality agreement (with pro forma examples)
  • How to use extracts from other people's material, without breaking copyright.
  • Options for using other people's photographs
  • What's in a name? A guide to naming of your **** (this could perhaps be a series run over a few editions...maybe 'new product', 'company', website etc, Also, deal with a situation where you have a fashion shop, and your real name is Ted Baker, or Mark Spencer, or Calvin Klein... what limitation do you face)
  • Don't let another company's patent application stop you! (guide on what to do when another company publishes a 'blocker' patent application - one that has little chance of being granted)
  • Retailing - what rights do manufacturers have over their brands.
  • Plagiarism... (again perhaps a series). e.g. if you're florist, and want to put a guide on how to arrange your flowers, there are only so many ways to describe it... but there must be many thousands of websites saying the same thing. Also... terms and conditions. There are only so many ways to word them. What you can and can't do.
  • Music. Article on how to play/use music in your business, on your websites, promotional videos.

Thanks PrestonLad.

In respect of the confidentiality point probably the best free guide that exists is the UKIPO one. I'm not sure we could improve on that:

As to your other suggestions we'll have a think and see what we can do.
