help to get out of my phone contract with Orange Business

Ok so, I have a Business Contract with Orange, i was with them for 2 years, then in Feburary this year i finished my old contract and took out another contract with them for 24months, the phone I chose was a HTC S740.

Since i took out this new contract the phone has had to be replaced 4/5 times as the screen keeps either smashing or just simply does not turn on. This is causing disruption to my business as a sole trader plasterer this is my business phone number and people cannot get through to me.

So tonight i had to phone for a replacement phone as yet again it broke earlier on today. I said i wanted a different phone, i didnt mind paying for part of it and i would give this phone back, however they said this isnt an option as it is an automated computer system and they cannot select a different phone.

I asked how much then it would cost to buy myself out of the contract and they said £420 as i have 14 months left at £30 per month.

It is one problem after another with this phone, i want to get out of the contract asap! please help

Primarily, you have not received the service you expected, so I would say that 1. you are losing business and will charge Orange for the business you have lost. 2. You have received was it 4 new phones which has far exceeded anyones patience especially as this has disrupted your business over the total time period. 3. as they have failed to supply you with an essential service for your business they have broken their contract with you therefore you should be free to ditch them.

If they still say pay up I would say you are going legal and to consumer rights.

Stamp your feet hard enough with orange and they WILL always upgrage and change your phone for free. (they MAY want to re-start your original contract) We have had the same issue with about 4 of our Blackberry's and eventually they have always changed the model when needed after i've thrown my toys out the pram!...for good reason!

I saw the issues you were having with Orange and your HD2. I know its frustrating when your livelihood depends on a working handset and contract rules can seem rigid when your looking at swapping/replacing phones.

I would advise you to get another HD2 if that's all they can offer being as that's what your paying for, but if its essential that you need another handset and Orange still wont give you one then it would probably be cheaper to buy a stand alone handset than to buy out your contract, at least this way you can still keep the HD2 and you wont miss out on your inclusive minutes and texts etc.

Being a plasterer I'd recommend a sturdy phone that will handle your day to day activities this way you can get a phone that lasts and not have to go through the trials of repairing and replacing. I personally like Nokia's as they are quite durable but if you go to a store you can have a play with the phones yourself and decide which is suitable.

    Mobile phone screen don't just smash on their own! :p

    If the OP has broken his phone then this is not Orange's fault and he has absolutely no statutory right to claim compensation or even a replacement phone unless he's got Orange Care.

    I'd recommend you bite the bullet and buy yourself a Rugged phone sim free and then put your Orange sim in it.

    I did a quick Google search and found this for £120, I'm sure you could find cheaper if you scout around, just search for "rugged".

    Nokia 3720 SIM Free

    If you were lucky enough that Orange would replace your current broken phone then when the new one arrives just sell it on ebay to go towards the cost of a proper phone more suited to your needs.

    I have to agree with the above, I think this is the phone with the slide out keyboard etc, its hardly suitable using on building sites and whilst plastering, get a cheapo nokia or a samsung solid, something designed for that sort of use.

    I believe phones dont form part of the contract.

    That way they dont get any cancelled contracts on non working phones.

    However it bites them in the behind when you CAN cancel a contract because of change of terms etc because you DONT have to give them the phone back.
