Help needed with defence and counterclaim

I'm struggling to understand what outcome you are hoping for on here. It appears in varying degrees to be free legal representation, which won't happen, or just for people to agree with you - which is pointless.

You have been told in no uncertain terms, by the highest authority that your case has
no legal merit, yet you appear determined to continue on the same basis.

You have been given solid advice on here, particularly around presenting information that is concise, relevant, qualified and verifiable. At the moment you have a jumble of opinion, irrelevance with some potential meat hidden in the middle. No judge will wade through to extact the meat, it needs to be obvious

Apologies if I have confused you. That certainly was never my intention. I actually find it extremely difficult to ask people for help and I certainly do not expect anything for free. I actually feel extremely embarrassed to ask for help and to be in such a awful situation.

No I wasn't looking for or expecting any free legal representation. Unfortunately for this present situation, I am on my own and can only do the best I can. I am sleep deprived, extremely poorly, extremely stressed and do not have great mental capacity to think clearly and am clueless with legal/court procedures / forms. Sorry if I haven't met your expectations.

Yes I needed help with presenting a properly pleaded defence and counterclaim and yes, that has been provided perfectly and am so appreciative.

The extra information I provided was not intended to be my draft of a defence and counterclaim. I typed that after 2 days of no sleep, which is why it is jumbled the way it is. My brain is jumbled and I provided that extra information to try to give you a better understanding of some of the facts.

I had intended to draft my own defence and counterclaim using the tips I have been kindly given, but I think it might take me a couple of days and then would probably require a lot of tweaking and re-wording, which there simply wouldn't be time for.

I really need to get it submitted to the court very quickly and am struggling to do that. And would really appreciate if anyone could help to draft it.

I had 1 day to submit the previous one, which took me an entire day of trying to research online how to format it properly. I really did do the very best I was capable of. I received the most recent court order on 8th Dec, several days after the hearing, so really don't have much time left and I do not feel capable of drafting it properly, as I know it needs to be concise, and my brain isn't working well.

I cannot help the situation and have sought every avenue of assistance possible under the circumstances.

I really would appreciate if somebody was able to help draft it, otherwise my own attempt thrown off to the court is not likely to get me very far.

I am not even sure, if I need to complete another court form for the defence and counterclaim, or if I should submit it as a single typed document with the correct headings and statement of truth?

I tried to contact the court last week, but there was no answer on the phone.

They sent me a link last time to complete a help with fees form and an N9 (I think) for defence and counterclaim.

I am sorry to ask so many questions, but think I need step by step instructions and nobody else to help

For the millionth time, I am unable to instruct a solicitor. Hence seeking urgent help on this forum.

I have also been a landlady myself. And I know the law regarding tenants rights and landlord/lady obligations. I can assure you I am not liable .

You want the judge to decide? They will. By what you have been posting the posters on here can all guess what decision will be made.

Once the judge has decided, expect action to be taken to recover the money.

You cannot afford legal help. So write the response ignoring or using advice as you see fit.
Don't expect after the responses you have given to get much offered help from others. As you say you have experience of renting out property, use that as a basis.

Those wanting help usually are somewhat better at dealing with other people.
My sister in law offered to help when I asked her earlier on. She solves housing and rent problems for a living for the past 20 odd years.
Will let her know her help with the writing of your defence is no longer needed. In fact I'll send her a copy of the post, she'll be quite amused.

Lots of vulnerable people around, some of them the other side of the keyboard from you. People who have been through landlord problems, people who do know what happens with the courts, people able to get others involved.

You don't want help, you want sympathy. Wrong forum for that, try boo.hoo dot com. Multiple instances on here of people trying to help you and rebuffed by you.

I think you are right.

No-one is likely to offer any help now, I warned you in my earlier reply, set things out in a polite, respectful manner, and stick to the important facts. That means to everyone, the judge, the claimant, the forum.

Getting emotional does not change the law or the way a judge will rule. Since the above advice earlier, you have dropped several importantly missing facts, who knows how many others you have not disclosed.

If you want to you have time to submit a defence, but based on the latest information I think it will be a waste of time.
