Fixed Price Energy Contract Early Termination

We moved business premises last August, at the peak of the energy crisis and had to sort out a new energy supplier on moving in.

We found a rate online with Smartestenergy for a one year fixed contract, but when we contacted them, we we told that option wasn't available & the only options was a 3 year fixed contract but that would be best advice anyway due to the rising prices.

We are now locked in on a 3 year at a rate of .75p per KWH (electric only) and to get out of the contract, we have to pay the cost of the remainder of the contract.

Do we have a case to get out of the contract early? I haven't contracted them yet as I want to get my facts straight before I do.

What is the ‘case’ of getting out of the contract early?

Depends on the wording of the contract agreement. Unless there are some exit clauses or the the supplier has broke any part of their obligations to the agreement, I don't think you have a case.

It's very unlikely you will be able to terminate the contract unless you can show the terms of the contract have been breached.
