I have just won an auction on eBay. I read the description quickly. It was for an xbox 360. I won the item and when i read the description again it is just a box. It described the xbox etc and they have worded it well enough for you to bid thinking it was for the console if you skimmed over the advert (error on my part). I emailed the seller and said, sorry i thought i was bidding on an actual console, they have said tough basically and said there is no refund.

Surely they can't do that? I was silly not to read the advert thoroughly but it was an error and why would they sell just a box? If they don't offer a refund i will leave back feedback and contact eBay. Can eBay ban them for this? Surely a scam?

You have won the item, but if you have not yet paid for it yet, you can think about this - Just ignore it without paying. That too if you don't mind an unpaid item "case" being filed in your name.
They'll open a case if you don't pay for an item within the specified no. of days. You can talk to people from ebay at this point, if you feel your claim is right. This is mostly to protect the seller's rights - I guess they pay a price for listing each item. If you win, you won't get the case. Or else, too many cases and you'll be banned from ebay. Find it at the unpaid item policy page in Ebay.

If you have paid, you can take it to the resolution center. But its left to Ebay to decide.

I had a trouble like this when I guy sold me a casio watch of a different model, while the picture showed a nice one. :rolleyes:

You could also open a paypal dispute if you have paid.

Item not as described. He has told you all about an x-box and what it does, but a box will not do this.

The money will be taken back from him until the case is resolved.

You should post his user name on here as that is a scam.

A scam? how so? If the seller described the box as being a "x-box" box,then that is accurate.The OP stated that the item was described so that someone NOT READING THE DESCRIPTION PROPERLY could be mislead.

I don't think the OP has any grounds to complain to ebay.If the sellers are doing this full time,they will know what to say to ebay and get their money. And in future remember "caveat emptor"

It's an old trick that one, like the dolls house furniture and is actually a 'hustle' or if you prefer scam but regardless of the buyer not being diligent they have been preyed upon...

I'll not kick you when your down mate but you do have two options here, firstly just don't pay for it which normally wouldn't be ethical because by technical knockout you are in the wrong however in the circumstances justified under the old testament. Your second option is pay for it and have some fun with the b'strd in hope that they will send it by the cheapest mail service non-recorded (not signed for), then open a goods not received case on PayPal which the seller can't prove you received and by their own rules you get a refund and there are no goods to return. Then take a picture of the box on fire and list it on Ebay for sale, let the original seller know about the 'other items' you have for sale that week...

"X Box Carton : Slight Fire Damage" which you could always post back to the original seller if nobody buys it. :D
