I represent a small business, and we have recently made the mistake of paying someone a small fee upfront for lead generation. We were sceptical at the time but the person involved sounded very keen and seemed to know his stuff.

Long story short we got nothing from this person. We asked for a refund as the deal was not what we agreed, but as expected it was refused.

To be honest we thought this was a risk and so the money was already written off but we are angry that we have sent a batch of data accross for them to contact and I have the feeling we have not only paid money but had our data stolen.

Is there anything we can do to either get payment back to justify the data sent or stop them using our data for their own uses?

The data is likely to be your copyright and also any database you have created may qualify for the new database right.

You can ask for destruction or delivery up of all materials which are your property but it is difficult in practice of course to ensure upfront that they don't keep a copy.
