Car damaged by 3rd party company, but they are not giving me their insurance details

My car was having some work done in a garage and they damaged the vehicle body work.

There is clear CCTV from another premises where the garage are clearly liable, but the garage are not giving me there insurance details.

My insurers Direct Line are suggesting that i make a claim on my own policy for the damage, but this dosnt seem right, that they get off scot free and im left with paying my excess and increased premiums.

Im thinking of issuing proceedings which i think i would clearly win, but they are a LTD co and could just fold the company.

Any ideas how to get a) there insurance details b) a resolution to the issue ?

I do not think they have to give you details of their insurance if the damage was done on their premises as opposed to the public roads. If they have insurance which will cover this sort of damage, it is likely to be public liability insurance or other business insurance. You will probably have to engage the services of a solicitor and take them to court.

PS. was there much damage done?

    You don't need their insurance details. You need them to fix the problem or pay someone to fix it. How they pay for it or whether they choose to use their insurance is not your problem. I agree that them folding the company would be a problem, but it is an extreme measure for avoiding a few hundred pounds of damage.

    +1 to Kulture's post. They don't have to give you their insurance details or use insurance to sort the issue.... but they do need to make good the damage suffered by either repairing the damage to the car or reimbursing you for the financial damage suffered in getting it fixed.

    As for the best way to resolve, show them the CCTV and inform them that either that repair the damage or you will get someone else to and will take action to recover the cost from them.

    I am guessing that the damage is not enough for them to scupper their company unless they are all ready in big trouble ! Do you really want to issue a winding up order and end up even more worse off
    I would contact your local trading standards if they wont play ball

    If you have legal cover on your insurance, use that to get proper advice. By the sound of it your insurers should sue them under your policy if you have legal cover.

    Unfortunately the damage is multiple thousands of pounds. Are they required to provide insurance details as they where driving my car then parked it with the hand brake in properly applied which rolled off and caused the damage ?

    They are only required to provide insurance details if an accident occured on the public road. Multiple thousands of punds of damage because the handbrake wasn't properly on and it rolled? Was it parked on Porlock Hill?
