Business solicitor needed

We're looking for a solicitor for our joinery manufacturing business. We need terms and conditions writing, how and when to give them to the customers. We want somebody who we can call on when issues arise to tell us how to deal with them. Customers are NOT always right. They abuse our products then come back to us when they have issues and we just don't know how to deal with them.

We have an ongoing dispute with a customer at the moment and we want to protect ourselves from anymore issues like this in the future.

Here's a summary of the ongoing one. We're not looking for free advice although that would be nice. We are willing to pay.

I sent a form N181 requesting a stay and I need to decide what to do.. The claimants pushing for mediation but I want to defend the claim. Here's a summary.

We are currently in a dispute with a customer. I can explain the entire situation, but here’s the summary:

The customer ordered bespoke doors from us, which we unfortunately made too short. We didn’t replace them promptly, and understandably, the customer became frustrated and filed a Moneyclaim against us. However, in the claim, he also included another set of doors. While he had briefly mentioned an issue with these doors some time ago, we had responded to explain the cause of the problem. Although it wasn’t our fault, we offered to advise him on how to resolve it. We didn’t hear back from him about the second set of doors until the Moneyclaim came through.

We have since paid the portion of the claim that we agreed to, but approximately £7,000 remains in dispute.

We sent form N181 to the court saying that we dispute that part of the claim and requesting a stay which has been agreed but we don’t know what to do now.

Before 12th February we need to have taken one of the following steps:-

either

the claimant must notify the court that the whole of the claim has been settled; (see note(i) below)
or

the claimant or defendant must write to the court requesting an extension of the stay period, explaining the steps being taken towards settlement and identifying any mediator, expert, or other person helping with the process.

The letter should confirm the agreement of all the other parties (see note(ii) below)

or

All the parties must file a completed directions questionnaire at the court. Where a settlement of some of the issues in dispute has been reached, a list of those issues should be attached to the completed questionnaire. The list must be agreed wit the other parties and must indicate that it has been agreed.

The customer sent us an email “. I believe the best way forwards is to appoint a qualified expert followed by dispute resolution, do you agree?” and he attached details of a dispute resolution person.

Would it be wise to go through somebody that the customer has recommended or would it be better if we found our own. Or is there another route to go down. We believe that part of the claim shouldn’t even make it to court as he only mentioned the second set of doors when he put the claim in for the first set of doors which we agreed we owed and have paid the full amount of.

It is quintessential for joinery manufacturing companies to have the right terms and conditions in place with continuous support for legal consequences in case there are disputes or litigations arising. Looking at your main case, considering a third-party mediator independent of the customer-suggested expert seems advisable. Thus, the appropriate response could well be filing the directions questionnaire accompanied by defending against the disputed claim part. Yes I can mediate this dispute. I am the leading mediator using technology (such as blind bidding which removes the need to sit on offers -see for example this news story ) I am organising a major international conference on Online Dispute Resolution in April - See here.

As to general work I am shortly launching a 'Head of Law' service for a few small companies in which I provide, on a fixed retainer rather than hourly fees, ongoing preventative advice . Creating and servicing T&Cs would be part of that service as well as helping to ensure disputes are either avoided or at least resolved before escalation .
