Hi

Supplier Chain is currently:
End Client->SupplierA->Agent->Mgmt Co->My company.
->SupplierB
->SupplierC

I have a contract which has a clause of 12 months preventing me (My company) from working with a client (SupplierA).
Agent has a contract with SupplierA only which has its own clauses (I have no details). Agent adds no value and duped me into working through her company with false information.

The End Client has posted a new position to its suppliers (A,B,C) which I want to apply for. I do not wish to use the current Agent for reasons mentioned and not relevant here.

Any of the following works for me

End Client->SupplierA->Mgmt Co->My company
->SupplierB->Mgmt Co->My company
->SupplierC->Mgmt Co->My company

Could I apply for the position using one of the other suppliers?
e.g. if there are any contractual obligations stating I may not work for A,B or C, are they enforceable?

Thanks in advance.....

Depends on the strength of the evidence of misinformation and to what extent can prove that you would not have entered into the contract with the Agent had only truthful information been provided.
