Hi can you help ? I am owed money from a Bad debt but the company has now gone into Liquidation !
I have been called by a company claiming they can go after the debt for a small fee and if the get the Funds back They add the fee on top to the Person in question! The company has started up again !! any advice please ?
 
Let the liquidators run their course, and see if you get anything back... I wouldn't hold your breath.

These companies have no more information than you do, no special powers, and I suspect have zero effect on your chances of getting any money back.

Be prepared to write it off, and be surprised if you suddenly receive a cheque for a couple of pence in the pound you're owed.

There is nothing this company can do now the debtor is in liquidation. The fact they have started again is irrelevant (if annoying)

Not sure if it still works like this but years ago someone bumped us for a canny sum, we got list of creditors and debtors. He was opened with 2012 or something at end of his company within a week. We went to all his customers and took over enough to get our money back and some

The same company with the same company number has started up again?

Or new company that doesn't owe you any money has been started? Very different thing.

Liquidation - unless the company has lots of money owed to it or lots of realisable money in assets then don't expect much from the liquidator. They get paid first of course, you somewhere down the scale of payment.

Company going after the debt for a small fee - can do exactly what more than you can at this point? Deal with the liquidator.

These letters are a con.


Unless:

1. You have bad debt insurance
2. You can prove fraud occurred
3. You have a personal guarantee for the Company debt
4. You have retention of title or other form of security
5. You paid over £100 on a personal credit or debit card and can claim the monies back from your Bank under S.75 of the Consumer Credits Act
6. Your debt relates to a deposit or advance payment that was kept i a separate client account held on trust...

Then I'm afraid the only chance you have of getting your money back is via an unsecured creditor dividend in the Liquidation.

Make sure you lodge a claim with the Liquidators.
