hi, I'll be honest, I want to get out of a contract with a franchise company I bought into, as the are such a cowboy outfit and I am tired of their lack of professionalism.

When I bought into the franchise, I had the contract fully checked over by a solicitor. After signing the contract (about 6 months ago) I notice that an extra point has been added to the contract. This was never pointed out to me, on the day of the signing, and neither parties initialled the point.

My question is, can I null and void this contract on the above basis and could this actually be considered a criminal offence- perhaps fraud?

Yes , assuming you have a copy of the contract as signed ( your solicitor will if you do not) the additional clause is of no effect. Whether it amounts to fraud depends on its wording and how it became included. He may have asked his solicitor to include it and he failed to do so.
