Your first port of call should be ACAS 0800 470 0616, explain the situation and follow any advice they give you. If you ever took this further to a tribunal everybody has to work by their rules and so its a good idea to get their opinions and any advice they can offer you, if your company takes any action against you, they too would be following ACAS advice, so they would be the first people ask advice from.
