Rules About Redundancy Pay

I’ve worked for an organisation for just over 3 years now on a fixed term contract. Now the contract is ending they need to make me redundant. This process has started.

I have two questions about this which I could ask the union but I’d rather not.
  1. If I’m offered another job by a different organisation but turn it down am I entitled to redundancy pay? Admittedly how would by employer know.
  2. If I decide to go self employed am I entitled to redundancy pay?

You are entitled to redundancy pay (broadly) unless your employer offerds you an altrntive suitable position and you unreasonably refuse it. Or if you resign before the redundancy trmination

Thank you for the reply. The other thing I was wonder is as I need to be given a meeting at the three month point and the one month point o let me know I’m being made redundant what happens if my employer fails to do this?

I’ve been given the three month meeting to let me know I’m being made redundant but 28 day meeting point should be Friday but I’ve received no mention of this and the head of HR has just left so I think this might have been over looked (plus HR are a complete mess).

Your employer is required to consult over redundancy. If they fail to consult appropriately it will be evidence against them if you claim that the redundancy is unfair. Otherwise, nothing happens.

Thank you. As my fixed term contract is due to end this month I’m guess arguing unfair dismissal would be hard? In which case it is time to move on.

One of the reasons for consultation is to identify suitable alternatives. If there is a vacancy that you could reasonably fill redundancy would be unfair. Otherwise, yes.
