just to update - looks as though selling the rights to a larger company is going to be the easisest and best way forward - even after selling the rights - the info i have been given is that i can write into the agreement that i can take a small proportion from each sale therafter too.

I dont think you can deduct pay for not working their notice.
But you only need pay them what is owed. so at the start of their paying month you owe them nothing.
However if they have taken more holiday than they have accrued you are entitled to payments back from them.
from what i heard its 60% of their salary - of course what there salaries actually are was not disclosed but im assuming between the 150-200K mark.
hopefully others will follow the same path.
