Help With Staff Leaving

Hi

I am hoping someone can help me with this.

I have just had a staff member leave, by text, without giving the four weeks notice required in their contract.

Their contract states that the company can take from any outstanding wages a day's pay for each day they don't work their notice period.

Is this possible and also what happens if they have no pay due as they left at the start of the month?

I dont think you can deduct pay for not working their notice.

But you only need pay them what is owed. so at the start of their paying month you owe them nothing.

However if they have taken more holiday than they have accrued you are entitled to payments back from them.

The full terms and conditions of the contract need to be reviewed before any advice can be given. Some contracts have provisions for making any deductions and the reasonableness and thus the enforcibility of any provisions have to be assessed also.
