Hi,

I am an Uber Eats restaurant partner as a sole trader. I am owed some money from Uber but haven't received it yet.

I am planning to change the business to a limited company.

Will I still be able to receive the money I am owed?

    While I'm not familiar with how Uber Eats operates, you as a sole trader are owed an amount of money from Uber. You personally will still be owed that amount by Uber. You just cannot include this income as part of your new Ltd. It'll have to be declared as income the same way as you've always done, i.e. on your self assessment.

    Have you discussed your plans to go Ltd with an accountant? If not, I would always suggest doing so to make sure you get things right from day one. Trading a business through a Ltd company is very different from working as a sole trader.

    I was just unsure if Uber could tell me that since the sole trader business doesn't exist anymore, they'd no longer have to pay me what I am owed.
    When working as a sole trader, the legal entity is you, and you certainly still exist.

    I'm curious how Uber owe you money? My understanding was that they send you the orders and you pay them a percentage commission?

    In answer to you question, as above - if they owe you the money, it still stands regardless of you creating a Ltd company

    All orders are paid online so we never collect payments from customers. At the end of each month Uber pays us while keeping their commission.

    However due to some issues with their payment system, we haven't received any money for the past 3 months.
