Asked to help defraud the furlough scheme

Where to start with this rubbish.

The fact a business may not be open to the public does not preclude it requiring employees to return to work at any time. Furlough is at the absolute discretion of the employer and can be cancelled at any time.

The OP is asking about someone being required to return to work while still furloughed. That is illegal and a fraud by the employer. If the employee does not want to return to work and does not want to report the employer for the fraud they have zero options.

Carl stated "The boss is basically claiming on the furlough scheme and having them work.", that being the case nothing I said was wrong re his son in law not having to return to work.

As regards your second question my bad! Put a comma after can't...…."If to keep him safe - and therefore satisfy government criteria to re-open legally - he needs to wear a mask and can't, then consult a doctor."

As for your final point not returning to work is an option if still furloughed!

    Whats missing from the comments so far is that the employer has to notify the employee that furlough has ended on such and such a date and they should return to work. I would request that by email or in writing (would you agree Cyndy?)
    Definitely, and a confirmation that they are returning to full pay.

    1. You can put people on and off furlough by the way - i think on for 3 weeks, off for 3 and rotate them. I don't think that is being done here but it is possible.
    2. Most people on furlough are allowed to get jobs with other organisations at the same time (unless their employment contract prohibits it).
    3. if I were he and the mask is the issue just work without the mask on.

    You can take people on and off furlough, as long as each furlough period is a minimum of 3 weeks (otherwise the money cannot be claimed). the time between furloughs can be as little as 1 day.
