Win Win management (UK) Ltd: Contract breached for 2 months still valid?

We have a phone contract & we have to pay £78 a month for it.

They are supposed to pay us back £30 per month every 3 months however they are 2 months late with payments, despite being told 4 times it would definitely be paid on a certain day & generally I have had to chase this all year for payment.

Yesterday the director called us apologising & saying it was due to this and that but that it would be paid by the end of the day yet no payment is received.

They also did not pay off the old contract as they said they would which has resulted in this being on my partners credit for 6 years even if they do pay it.

Is them breaching the contract for 2 years and not paying the old contract as they were supposed to cause to seek legal advice against this business & generally is it breach of contract.

Have reported to trading standards, left them reviews anywhere I can & sent them countless emails which have not been replied to, when we call them we just get excuses.

Surely if I am supposed to abide by what's in it so are they.

Hi Karl,

Yes if the pay back was included in the terms then they should be sticking to their side of the contract. However sometimes the terms may state a period that any breach must be remedied by.

What is it you want from their failure to stick to their obligations? End the contract?
