Who owns the trademark?

Hi there,

I have a limited company that I use to run a commercial website. I'm looking to set up a similar venture but this time as a social enterprise so under a community interest company. The easiest way for me to do this is to transfer the company over.

This will also require a name change plus newly branded website. I'd like to keep the old brand to resurrect at a later date for commercial purposes. The original trademark and domain name were acquired in my name rather than the company's, so can I assume that this won't be automatically transferred to the CIC?

The original trademark and domain name were acquired in my name rather than the company's, so can I assume that this won't be automatically transferred to the CIC

If you registered on behalf of the company then the trademark and domain name may be considered a company assets. So you may not be allowed to retain ownership.

Apologies, I missed your reply. Thanks for the info. If I own both company and asset, who makes the decision as to where the true ownership resides?
