Where do i stand?

Ok, so i ordered a New Jobsite Script from a company in the US and paid via www.2checkout.com £102.00

I was impressed with the demo from the company, it was fast and worked a treat.

They installed it for free on my server, But last night when i went to get on it it was so slow its unreal, i was having to wait 2 or 3 minutes for the page to load

So i sent them a support ticket, asking them to sort it and i've not heard nothing back, going back to the site http://www.easyjobscript.com/support.html and the site is down and i've not had any replies

Where do i stand? Can i get in touch with my card company? I want a full refund, can i get one?

Was this the website?
http://web.archive.org/web/20130115064232/http://easyjobscript.com/

My advice -
I suspect the script dialled home to the supplier (in this case Easy Job Script)
If their server is down, then that probably explains why your system is slow or not functioning

I'm not sure legally how you stand

Best to contact the payment provider and your CC company and see what they can do

It looks like the site is still down. They actually registered the website with Go Daddy but host it Houston, USA
It doesn't bode well when you look at this page and realise that it looks they have several different versions of domain names:

http://www.solvedns.com/nameserver/ns1.easyphpserver.net

This page shows the current health of the server:
http://www.solvedns.com/easyjobscript.com

It could be a glitch, but my advice contact your credit card company. I'm not sure what the procedures are for chargebacks on digital goods, but read this page - it will help:

Good luck

That is one seriously slow website! Told me at bottom of page "this page was created in 8.59 seconds"... If that is how long it takes to create a page then it's going to take a lot longer for the user to download and parse it.

I'd get yourself some new software and/or hosting... That is unusable at present

I wonder if you could cheat a bit. Do you know specifically what site it attempts to connect to? You could possibly add the site to your /etc/hosts or hosts.txt file and make it point to another IP address (e.g. 127.0.0.1). This will fail, but it'll fail instantly which might be enough to speed things up, at least temporarily.

To be honest, I don't think it's all that simple and I wouldn't go trying to get a chargeback. I'm surprised people have advised that as you could end up creating a problem for yourself.

That is a commercial, open code product - much like vBulletin or Invision. Read the license agreement, it's not too disimilar to vB and Invisions. Basically sold as seen and without refunds. This is quite normal because it's an open code software product that you hold. So without that kind of clause it would be too easy to pirate it.

As their site was down while your site was playing up, it stands to reason that this was occurring because of a background licensing callback. If their site is experiencing technical difficulties while that callback is in process, that could affect the stability of the product on your server.

Licensing callbacks are a product of the times and something we will all be getting used to as most software is going down the routes of online callbacks to check license validity due to pirate versions of the software. If the callback won't complete the software won't work.

Also I'm on their site now and playing with their demo and it seems fairly quick. So the issue could well have been temporary.

I don't see a temporary failure due to technical difficulties on a server would stand as "not fit for purpose".

With that all in mind, you have to think about whether the product itself genuinely isn't fit for purpose or isn't what was sold to you.

Unless you can demonstrate that, they can hold you to the license fee.

So, I would contact them, talk to them about why the site failed and take it from there, else you could end up in a bit of a situation.

There is a moral to the story here though.

1. Make sure you understand the license agreement and read it (when it says no refunds due to it being a digital product, keep that in mind because it is enforceable; especially with open code products; unless you can demonstrate that it is not fit for purpose or not as advertised).

2. Make use of the demo and check for reviews of the product or a local demo of the product (i.e. a demo version you can install on your server for a period of time - or feature restricted)

3. When you buy a 3rd party product like that, there are risks of bugs and things not working properly.

It all depends on their licensing terms I guess.

I would be tempted to try preventing the dial home feature, apart from twice a day. You cannot have a website that for each page load, it checks with an external server, before loading. Even if the request is 0.5 seconds round trip its delaying the site.

8.59 seconds?! It needs to generate (excluding download time) within 1 second.

I tried out the script online and I liked the features. It seemed fast. I bought the script and addons and installed it on my dedicated server that only has one other site on it that is in development. Traffic is nill. I keep getting mysql is gone and cannot connect errors.

Support is very slow and spotty. They offer free installation when you buy the script, but warn you it could take 3 days. If it is so simple, why does it take 3 days?

I could see if I was on a shared host, but an almost empty dedicated with no traffic should make this script fly.

I am at the point that I am going to contact 2CO and get a refund. They are a little shady though so if they won't refund, my bank will.

I am really not happy with this company. They are not an American company - just correcting the info above, not putting them down because of it. You can tell by their correspondence and the grammar on the site itself that English is a second language. They have hidden who owns the domains with private registration. I asked where they are at and they will not tell me. They are running their site through hostgator at the planet. The same server farm I am using.
