Using family members as trustees?

Hi all,

I'm hoping you can help. I've tried looking at this on the Charity Commission's website, but I've read through 100+ pages of guidance and still don't seem to have found a clear answer! I'm looking to set up a new CIO (charitable incorporated organisation) to help promote a recreational activity our current LTD promotes. We'll be hoping to split the two, so the LTD continues trading separately, whilst the CIO works to raise awareness, campaigns to increase participation etc...

The only issue is the moment, as this is just beginning, I don't have three external trustees I know well enough to bring on board. The only option I (may) have is to use three trusted close family members (i.e: wife, mother in law, brother etc) initially whilst I try and find the right people to take over in due course.

Is this a conflict of interest, or likely to cause any legal issues? I'll include a conflict of interest clause in our governing document to ensure there are procedures in place to handle any potential issues, but as they're all outside of my industry, without any business or financial interests surrounding the project, I was hoping this would be OK.

Would anyone be able to offer any guidance on this please?

Thanks Mr D,

So if I was to incorporate with family as trustees, but had perhaps a review period within our charter that aimed to recruit non-family members as soon as possible on the basis that without this initially, we could not set up, do you think this would be sufficient for year 1?
