I am currently taking legal action against my former employer due to having disciplinary action taken against me for 'under performance'. They had no evidence for this yet dismissed me. I've already been told that I have a case and a solicitor will be taking it on.
However my main concern is that in the meantime I am trying to find another job (I'm a graphic designer) and that any potential new employer will ask for references, and surely my last employer will give me a bad one.
My question is.... if I win my case and its proved that I was unfairly dismissed will my disciplinary/dismissal be wiped from my record, i.e I wont have to mention it to any future employers.
