Trademark, Protection, Copyright help please.

I have a business name/brand i have recently started, i own the domain name but other than that i have no idea where to start in regards to owning and protecting the business name do i follow trademarks? copyright? ltd company? registered company?

any help or info would be greatly appreciated.

Trade Mark is what you need for a business name. Even if you are a sole trader a TM is often essential to protect your trading name.

You will need to register your business name as a trademark with the Intellectual Property Office. If you register your trademark then you should be able to prevent others from using the same or a similar mark. The trade mark application will need to be in respect of the goods and/or services that you want to use the mark on. Once your application is filed it will be examined to see if the mark is acceptable for registration. Marks that are descriptive or generic are likely to be refused (you will not get your money back!). Assuming that the application is accepted the mark will be published and open to objections from third parties for a period of two months (extendable for a further month). Assuming that no oppositions are filed against you, your mark will then be registered. The whole process normally takes about 5 months.
