Trademark issue with Toys R Us.

Hi everyone.

Just wondering if this business name (Glowsticks R Us) would cause an issue with "Toys r Us"

Would they be able to sue me for a trademark or copyright infringement?

Many have tried using R Us and failed. Take a look on the IPO website and after a bit of searching you will find many past cases which have all successfully contested.

It would be better to choose a different name.

Having looked at IPO, dont think they have all been successfully contested - see http://www.ipo.gov.uk/o21606.pdf

In this case, a claim by Toys R Us against Small Claims R Us was unsuccessful.
In short (quite a long and complex ruling), Toys R Us tried to narrow the gap between their activities and those of Small Claims R Us, but the ruling considered there was adequate space between their activities so as not to create confusion, and also the distinctive nature of the script and reversed R in the Toys R Us logo compared with a normal scripting in Small Claims R US logos meant the case went against Toys R Us with costs.

Toys R Us presented considerable evidence of their business might, but this was still not enough to win the day.

However, I would think Glowsticks R Us would be struggling under the similarity of the business activities.
