Hi there,

I was wondering if someone could advise on a possible trademark I am looking to register but could advise if it might be successful?

There is currently another registered trademark in the class I am looking to register my name in. There business name has a different letter on the end in comparison to mine. So each of our names is the same APART from the letter on the end is different.

I am in a completely different type of industry/business to this person and they who sell iphone covers and t-shirts. Mine is media/publishing.

Any thoughts?

It's difficult to say whether the other mark could be a problem without knowing exactly what the marks are and what the goods/services are of the respective marks. Generally, a trademark registration entitles the owner to prevent others from using not just the identical mark as registered, but also any confusingly similar mark. If the two marks in question differ by only the last letter then it is very likely that they would be considered as similar. Such a small difference would not be sufficient to prevent confusion from arising. However, this may not matter if the respective goods or services are totally different. Iphone covers and t-shirts are probably sufficiently different from media and publishing, although such services can involve many things. For example, if you were involved in on-line publishing about iphones or clothing then this might be considered as similar.

Thanks for the heads up - There are completely different sectors. There's is iphones and covers so product based where as mine is publishing and not selling a physical product as such more of a service... I may try and see where I get with it.
