Trademark Enquiry

Hi all,

I've recently started putting together a small T-shirt business (Purely just for my knowledge as i haven't actually started selling just yet) and was wondering if anyone could help me with a Trademark enquiry i have. Say someones Trademark name is La Bonny Friz and mine is Friz High Standards and both fall into the same catogery of Goods and also both UK registered, would my Trademark not be accepted?

Hi Fletch,

I do not think it should be a problem unless the names have very close resemblance and same spelling. Normally when you apply for a trademark it goes into online journal for 2 months and gives enough time for someone to get back to you with their opposition if there is any.

Taking into consideration the example you have stated I do think it should conflict. Best will be to do a search first with in the IPO trademark journal for trademarks which are registered choose yours accordingly.

Best part is you can do all these searches yourself and dont need to pay any trademark consultant :)

Hi Fletch,

Based on the example you've provided, you should not have any problems in registering your trade mark.

Like Wajid stated above, you can do a free trade mark search on any of the websites below to find similar trade marks.
  • IPO Gov site - requires more input
  • The Trademark Hub - its more straight forward
Trade marks are grouped into classes and each class have thousands of descriptions so you can file your trade mark in the same category and still have a good chance to get registered. In the worst case scenario, you can register an image rather than a text only trade mark.
