Hi, If you registered (here in the uk and usa) "munchkin" would you be protected from someone using say: Munchkins, The Munchkins, Munchkin Sport? This is just an example, not really names. Thanks in advance for any help.

yes and no :)

a direct use of your trademark is the easiest to protect against, however there is a section in the law about being likely to cause confusion in the mind of the public - and variants may well cause that issue in which case your trademark will protect you - however it is never totally possible to generalise - a lot depends on product / your advertising / your market / your public / geography etc. if you have specific queries then I would speak to a trademark expert... If it is important to your business then I would consider protecting yourself more widely - trademarks are not expensive.

Trade mark registration protects against the use of any confusingly similar mark for the same or similar goods (or even different goods in some cases) in the same territory as that for which the trade mark is registered.

Please feel free to PM or email me if you need further advice.
