Trademark advice

I trademarked my business a year ago, however I have been running for over 2 years.

I am in the process of apposing another trademark, as it is exactly the same name as mine with one letter change. For privacy issues, I won't write it here, but say it was 'Blue Segways', the other business wants 'Blue Segwayz'.

They offer a very similar service, and it's a service that our business could expand to in the future.

I have received two emails, a text and a phone message from the other business owner, all quite bullying and threatening. This owner states that she begun her business a few months before mine, she has registered it with the inland revenue and she registered her domain name before me, therefore she could prove in court that I stole her name. Just for the record, I did have a look online for any domain name similar to mine a few years ago, and did not find anything.

Does she have a leg to stand on?

Hi Stacey

As you have a registered trade mark the other company is not allowed to use anything that would even be considered to be similar to yours. In fact, you could commence legal action against the other company. This would be a last resort however it is an option.

Hi Stacey. It's great that you have a registered trademark- this gives you a monopoly to use the mark for the goods and service it is protected for and it sounds like you are on top of the opposition. The third party you mention, if they feel they had a strong case could attempt to invalidate your mark- this would be their starting point- you haven't mentioned this so I am presuming they are not!
