Hi,

Company A - ourselves
and
Company B - competition

Company A has a German name and same domain name registered years ago.
Now company B trade marked its product in Dutch language which is same length
as company's A name and only one letter difference an it sound about the same.
Both companies conduct business in same industry. Domain name from company
A was registered years before company B put out their product.

Is there any general outcome in this type of situation?

About UK law and EU law in general.
We're years established UK company with German name of the company and German name of domain name.
Recently another company came out and registered a trade mark for their product which is a Dutch name and means the same as our German word. Only one letter is different. Both companies are in same industry but products are not the same.
Let say we do bicycle frames and they do bicycle chains.

Couple of questions:
- In which countries are you trading, e.g. are you only selling in Germany, and they only in the Netherlands?
- Do you both have a community trademark, or each just a national (e.g. German and Dutch trademark)?
- Are the trademarks registered for the same classes of goods?
