Take EasyJet to court for negligence?

A personal rather than business matter I'm afraid, but hopefully still acceptable.

Had a family holiday in July badly affected by EasyJet causing delays on both outbound and return flights. It has resulted in both significant extra costs for myself, plus a lot of stress and distress.

A recent High Court ruling states that I will not be able to take EasyJet to small claims for compensation due to delayed flights as per an European Court ruling.

However, it was made clear on both occasions of delay by EasyJet staff that the delays were caused because Easyjet had scheduled more flights than it actually had crews for. This has been confirmed by Stelios's recent and public letter to the EasyJet board demanding improvements in service.

In other words, as EasyJet were either negligent or incompetence in selling myself flights EasyJet knew they may not be able to staff, would I have a possible basis for making a legal claim based on this alone?

I ask because even though it's almost October, this is still causing stress through issues caused by this I'm still having to chase up.

Just wondered if perhaps there may be an option for a claim on that basis.

If you are stressed now, then I would give it up. Sometimes you've got to get on with your life, if I had a pound for every time I'd received poor service or been shafted, I'd be a millionaire.

High blood pressure, sleepless nights, and full of anger is a sure way to be grabbing the wooden overcoat early-Please believe me I've been there, it's just not worth it.

Just another point-and I don't want to rub you the wrong way- Easyjet, Ryanair are the cheap operators. You sometimes get what you pays for. Pay cheap-You get cheap

I'd imagine that any claim based on negligence would be a High Court matter, (rather than a Small Claims court, for instance).

You would then be in a position of funding an action against an airline, (with a fairly heavyweight legal team), at your own, considerable, personal expense.

Are you willing to punt tens of thousands of pounds against a smallish chance of winning a smallish sum?

I'd suggest your energies, time and money are better spent elsewhere, however unsavoury a taste that course is to you.

@Brian, sorry to here of your probs, budget airlines are a nightmare at the mo, only a few months ago ryanair were talking about charging people to use the loo. :eek: people said they would pee where they sat!!

There was a program i saw on Sky where Stelios ran a service to Switzerland but apparently he didn't have all the nessecessary paperwork so he couldn't charge for the flight. He gave everyone back 200 euros at the checkout in cash, but later he was on the flight asking everyone for it back :eek:

Cheeky monkey!! with all the money he's got he couldn't do with a few thousand euros, because of an easyjet balls up :rolleyes:
