Hi all

Have just joined the forum.

Hope you are all well and someone can help me.

I am looking to market the consumer via SMS messaging. However I am not too sure on the legal for this.

Is it possible to purchase lists of names and mobile numbers? - If so does anyone know a reputable supplier?

If not does the consumer need to 'opt-in' in order for me to send them SMS messages.

Any help and advice would be greatly appreciated.

Hi Dan

You can certainly buy, or rent, consumer lists for SMS marketing. The key legality is that the consumer must have given permission (opted-in) to receiving third party marketing messages via SMS. A legal consumer SMS marketing list will carry the necessary opt-ins in the form of a date and time stamp and the source of the opt-in(eg URL for Web opt-in).

SMS Marketing is something I offer on a partner basis with a specialist company who are the cheapest in the UK.

First of all the data you are looking for is "opt in" this means at some point the person has agreed to be sent marketing sms messages.

Yes you can buy the data. For raw data its around £4-10 per 1000 numbers, for segmented its hard to say. If you wanted to go after people with a specific hobby then its up to around £60 per 1000 numbers.

What sort of campaign are you thinking of?

By coincidence I got an email about this today from a reputable SMS supplier I use:

Hi Daniel,

The law is quite confusing when it comes to SMS marketing. Technically you can send SMS to "random" numbers as long as there is a legitimate way to "opt out", this is due to it being impossible to enforce and prove you didn't obtain the number personally. However I would not advise this. Getting a random list of numbers and spamming them is not a good way to market a business, it is one things that is ruining genuine SMS marketing.

Does anyone else get random messages regarding injury claims and then have the cheek to say text to xxxxx to stop these messages?

I think the reality is this, yes there are laws but does anything get done about it? I got an SMS from, I think it was someone like optical express, anyway a large and (allegedly) reputable company. When I challenged them about where they got my number from they just passed me to some 3rd party marketing firm and said they outsourced it to them.

Its like emails doesn't really matter what legislation there is it wont stop spam. Not saying its right just saying how it is.

Anyway back on topic like with emails its all about building your own list and persuading people to opt-in with compelling offers.

I'd also be wary of services that promise thousands of numbers cheaply.
