Hi, I need to write up some sort of contract for customers so that once I leave an item of property at their address, they are responsible for it until it is removed from their property by myself or by someone who has written confirmation from myself.
Can anyone give me an idea how to write it up?
Thanks

Hi,

It sounds like you need some terms and conditions of business.

These should cover not only leaving the goods at someone's address (as you mention) but several other matters too, such as payment, transfer of ownership, risk while at someone's premises, any warranties or guaranties given etc.

Although you can find general terms and conditions for sale on the internet, I don't recommend them as they hardly ever fit the business you are carrying out and, if you get it wrong, then your terms are pretty much worthless.

I tell clients that just one claim is going to cost them a lot more to deal with than getting the document done right at the beginning. Peace of mind, and sleeping at night (apart from court fees and damages) are worth the 300 - 500 pounds you might have to pay to get them drawn up properly.

I wouldn't feel too intimidated about writing your own document which outlines the conditions of this agreement. As long as your document includes some information about what is expected by both parties and has been agreed, you shouldn't have any issues enforcing the basic premise of the agreement. A simple bulleted list of points will likely be sufficient.

You may want to mention that the other party is responsible for insuring it against any loss or damage while it is in their custody. It seems like something like this could be forgotten and they'll think you're insuring it and you think they are.
