Slightly Odd Car Parking Question

Hi

i transferred to a new building in August
at this time i was told that i would not get parking as there were limited spaces (i was not happy with this)

i found out that there was a rota for the parking, and it worked like this

1)Top manager: allocated spaces
2)Middle Manager (ME): allocated spaces
3)everyone else: uses spaces when avail on a rotation

i was put on the list after everyone had said they did not want a space (effectivley 4)

i then argued and got myself uplifted to the level 3. (still not totally happy as still not treated as a 2)

the parking has now been removed, and all those with allocated parking (1+2) have been given permits for the local car park (£700pa) - but i havent.

Do i have a case to argue here (the other thing i could use is that the people with the parking permits are all male and i am female....)

no

this has nothing to do with the other thread ( i read that one ) this is about being treated differently to others in the same building

there are about 20 of us here in total.

it might not be fair, but i suppose it comes down to what's in your employment contract? does it state a parking space will be provided or not?

i dont think that anyone (in my company) has a car parking space by contract.

my thought was that we all had to be treated the same? if a person of one level has a parking space, then why not another person of the same level (is it that some are more equal than others??) - and if we are not treated the same, is it discrimination?

Which they should be paying BIK tax on.

Unless stated in your contract you have no rights to a car parking space.

It's an interesting point - are you being discriminated against on a non-contractual perk? You may need the employment lawyers on here to answer that.

But what reason ahve they given you for not putting you on level 2, or is there discussion over whether you are junior or middle management?

the closest thing to a reason is 'we are in different departments' (my team here is 2 people) we all work in the same overall area of the company

my level is a company standard contracted level which is exactly the same as the other people in the group 2

(i know i do not have a contractual right to a space, that is not the issue)

This does sound unfair but if it is outside the remit of your employment contract I can't see how you could argue any entitlement to a space or permit. I hope an employment lawyer will be along to clarify.

When I worked in London we were in an office of 1000 staff with about 50 spaces. You had to go on a waiting list to get a space but if you were friendly with the garage attendant you could easily jump the queue and the attendant did have a soft spot for the ladies. It was very unfair but because no-one was actually entitled to a space no-one complained.

with your example above, everyone was on the waiting list (the fact that the garage attendant worked on his own agenda is a bit odd but....)
