Sick pay please help

Hi all, i didnt know where to post this, but here goes.

I went to work on monday and by 3pm i asked my boss if i could go home as i wasnt feeling well.

That same evening i went to the doctors and they told me that i have tonsillitis.

It is now wednesday night and i am still not much better so i dont intend going in until monday.

I have kept my boss informed everynight whether or not i will be coming to work the following morning.

I was not given a sicknote from my doctor.

Should my boss have to pay me sick pay?

Hi,

Yes your boss still has to pay you sick pay even if your doctor has not given you a docters note, It would be best for you to get hold of a sick note tho just incase it comes up.

Its just to protect you even with a docters note your boss still has to pay you.

Your contract of employment will state what sick pay you're entitled to.

If you aren't entitled to any sick pay in your contract your employer still has to give you statutory sick pay (SSP) as a minimum.

As another poster has already pointed out under SSP you get nothing for the first 3 days of work that you miss, then after that you get about £75/week (ie a daily rate of c. £15/day assuming that you normally work a 5 day working week). A sickness that lasts for fewer than 4 days doesn't qualify for SSP. In order to be entitled to SSP your current employer needs to have paid you more than £90/week on average for the 8 weeks prior to your illness.

There are a lot more rules and exceptions than that, but the above covers most cases.

Hi,

You can self certify sickness for up to 1 week and your employed should present you with a SP2 from to fill out when you return. If your sickness extends beyone the week then you must go seek out your GP and he will invariably issue a sick note should you desire one.

The level of sick pay depends on what is in your contract of employment. Refer to the government web site at http://www.dwp.gov.uk/lifeevent/benefits/statutory_sick_pay.asp that will tell you all you need to know if your sick cover is in accordance to statutory requirements - these are the minimum by law.
