Section 20 and service charge

Hi

I have been given a Section 20 for some work that our landlord want to do to the building.

We have a service charge that is capped to x amount each year.

What I would like to know if the Section 20 is cover under the service charge.

Service charge is usually for day to day stuff and will not prevent you getting things like this (unless there are specific clauses in you lease about this).

We have a similar thing on a flat we have - £950 a year service charge, but they are redoing the roof and this is an additional charge of about £1500 from each of the leaseholders. Sucks, but thats the way it is!

If the service charge is capped then anything on a s.20 notice would normally be covered by the cap too - impossible to confirm though without actually reading the lease and making sure.

Things like the ground rent and sometimes buildings insurance, can be defined separately to service charges though.
