Royal Mail Business Account Postage Refund

Hello

I have a Royal Mail business account.

Under the terms and conditions of the account they do not provide compensation for delay, loss or damage. I understand and accept this.

However they are also refusing to refund the postage cost I have paid them when they lose a parcel. So they end up getting to keep the money I have paid for a service that they have not performed and then they also get a second postage fee when I send the replacement order to the client.

This seems like it should be against the law, as surely a company cannot charge you for a service and then not perform it.

My next course of action is to complain to the impartial Postal Review Panel so I would like some advice as to whether it would seem I have a case and if so some laws I could quote in the case.

Their terms state they do not compensate for loss.

The only way to get protection is insurance.

Their terms do state no compensation which I understand and accept.

I am not asking for compensation for the lost parcel but rather a refund of the price I paid them to do a service which they have not done.

I seems logical to me that no business should be able to charge a client for a service and then not complete the service. So my question is whether it is legal to keep the money paid for a service when it has not been completed.
