Returning headphones that don't fit?

Hello!

Earliey today I purchased a pair of headphones from a retail store. Before I purchased the headphones, I asked if I could try the headphones on (the reply was no), I asked if I could return the product after it had been opened (the reply was no). However, because all the stores I had been too were exactly the same, I inspected the headphones (they looked like they would fit) and bought them. I took them outside of the shop, opened the packaging and tried them on - they didn't fit. Is it possible to return the headphones and get a refund (I have a receipt and other forms of proof of purchase, I also payed on a debit card) ?

I've noticed that every single independent games/electronics store I have been to has had a no refund policy even when it is blatantly illegal. Case in point, my brother bought a second hand game from one of these stores and he couldn't access all of the features of the game because the keycode on the game was invalid. Eventually he did manage to get a full refund after some persuasion. Do you think that headphones not fitting properly classes them as 'unfit for purpose'?

Dont know about the headphones but agree that many chains are now adopting illegal returns policies.I think they are just trying their luck. A few years ago I had a running with a branch manager of Dixons whilst trying to get a refund on a faulty product. I actually sat on the counter and refused to let anyone pay for any goods until I had my refund. I was only young at the time and lost my bottle when they called the police:redface:, i'd stand my ground now though.

    You were told at the point of purchase that there would be no refund if they did not fit. You accepted that condition.

    They can do this for health and hygiene reasons. Also there is no obligation to refund just because you changed your mind.

    If they had guaranteed that the headphones would fit, THEN you could have demanded a refund.

    Not sure why you think they are blatantly illegal to have a no refund policy. It is only for faulty items that a store must accept returns. For any other reason like buying the wrong size, wrong colour, you've just changed your mind etc then they are under no legal obligation to accept returns and if they're then its as a gesture of goodwill.

    I am more curious as to how a set of headphones can "not fit". Is this a reoccurring problem you have or having seen the same thing in several shops did you think they were an unorthodox design? - in which case its very much a case of buyer beware

    Agree with kulture, you asked and they made you aware that the product couldn't be returned. So you can't really complain. You need to remember that once the packaging is opened it cannot be resold, so its a loss to the company. However, for the sake of a few quid I'm surprised they won't show a bit of goodwill.
