Registering product designs

Hi,

I am looking to register the design of some of our products but could do with a bit of advice.

I am wanting to protect the material & colour that the products are made out of.

Do I need to include the material colour details in the drawing or just leave it blank and then it covers all materials/colours??

I hope this makes sense.

Without knowing what your product is -my advice would be both.
If you are registering your design at the UKIPO you can apply register up to 10 designs for £70 (official fee) at the moment.

Registered designs are infringed if a product, made by a third party, does not form a different overall impression on an informed user, given the design field.

This means, if your product is a back pack, a "back pack aficionado" can sit down and compare the third parties product to your design, and to every known back pack design. The purpose of including known designs is that your design registration only extends to the new elements of your design. So features that reside in known designs are not protected by your registration.

Registrations are also limited to the form in which you register them. A black and white line drawing will confer greater protection than a photograph of exactly the item you are protecting, because the photo includes colours etc whereas the line drawing doesn't.

You can also disclaim certain parts of the design, for example, the length of the straps of the backpack, or the dimensions of elements to broaden the scope of protection.

Any Chartered Patent Attorney or Chartered Trade Mark Attorney will be able to assist you in registering your design in the most effective way to provide the broadest scope of protection.
