Refund

Hi guys,

I am asking an advice on following:

We made an online order for goods and paid by credit card. The order was for our customer who later canceled the order. The goods weren't delivered to us so we asked the company we bought the goods from, to cancel the order. They agreed to send us refund but this never happened.
I sent them couple of emails and they usually answered that the refund was already sent by cheque, but nobody is able to say the date when it went to the post.

What options we got to recover the money? Call the credit card company? Get in touch with solicitors? The amount owed is 844GBP.

Any advice is welcome.

Go to the bank and ask them, you should be protected by your credit card policy as long as you made the purchase online :)

Check the terms though because I assume this has been bought in the course of a business, not personally - entirely different terms.

I would write them a letter, send it recorded delivery.

Explain the situation, brief facts only.

Say that you are requesting refund for goods cancelled within 7 days of this letter or you will have no alternative to take legal action.

Just be prepared to pursue through small claims if you are going to say that though.

Yes, this was business purchase. I sent them an email already, with brief facts, as initially they didn't wanted to cancel the order. Under Distance selling regulations I can cancel the online order up to (I think) 7 days after the order is received. This order wasn't received at all. After that email they agreed to cancel the order and refund the money. It was over 2 weeks ago.

As per your advice I will send them recorder letter and give them 14 days time. Will see then.

If it was a personal credit card, you can claim it was a personal purchase - if it was a personal credit card, the credit card company will deal with it, however if they even ''think' it was for business use, they can under their terms cancel the card as personal credit cards are not allowed to be used for business!

As everyone else has said, DSR ONLY applies to consumer purchases, not business purchases.

Can anyone else confirm that?

I use my personal credit cards for business use all the time, spending up to £5k per month on flights, hotels, etc.

So do I to be honest, never experienced any issues but I think Kate is right - check the T&C's!!
However I had a problem with a company I dealt with took a payment for an ad and then put through a false one, said i had agreed etc, called the credit card company who told me they would sort it out, they gave me the refund and they must have known it was a business transaction!

If DSR doesn't apply within B2B transactions, what options does the business have to deal with dishonest business? Courts? What else?

Unfortunately there isnt a lot of protection. Get everything in writing i always say, cant go wrong then for example we see all the time people moaning that they havent been paid for this extra and that extra. Get it in writing and theres no arguments then. I try to make business as black and white as possible without being rude, far less complications later on.

Going back to you though, ring your credit card company and explain the situation, i'm sure they would try to help. In the meantime still send the letter saying you want your refund.
