Hi I was once involved with a company. There are no director in place. Company no longer running but not officially closed on companies house. Will public prosecution still go through with prosecution? No money in company, no representative

Minor issues … I don’t see any point of proceeding no money to pay fine . No director to represent company

For health and safety issues, like many other posts on here, details matter. There are circumstances where management and directors can be prosecuted for past actions.

If this relates to you as an employee suffering an injury in the workplace, there are protections in place - the limited company legally would have to hold Employers Liability Insurance.

Irrespective of the status of the company, you can make a claim with the insurance company - you can find the insurance company through the Employers' Liability Tracing Office (ELTO) : https://www.elto.org.uk/home/

For any other issues, it all depends on whether the individual directors/management team can be held personally responsible.

When I had a health and safety incident - it was only against ltd company with local council - they were vicious

Luckily had excellent insurance and legals - went on for 18 months against the company

When I decided to fold company as ins quotes where coming in 10,000 instead of £500 -
They then switched the prosecution against me personally as they knew they were to get no funds from company !

They were successful and lodged convictions against both in liquidation company and myself

I was fully covered by Insurance and they got no money from me personally -
Small conviction now spent - but just because company goes away doesn’t mean prosecution will from my experience

No injuries or anything. Was due to install of fitting not to manufacture instructions. No incidents and was fixed after it came to light by the company
