We had the same problems with these terrible company. Eventually I wrote to my MP, Vince Cable and he wrote a letter to the owner who lives in a mansion in Wales. Everything stopped immediately and all invoices were credited back. Please try the same, by writing to your MP. This company has to be stopped from scamming small businesses.

Interesting! I wonder what would be revealed if a thorough investigation was made into this company.

I did contact trading standards regarding problems trying to terminate my contract last year but they advised me to contact a solicitor. Unfortunately a solicitor wanted £250 just to look at the matter.

If I had the time or energy I'd create a website for people to register their problems with PHS.
Although I believe PHS are in breach of their own Terms and Conditions I was advised to cancel my contract in the correct way just to cover myself. This I did and back came the usual reply "We can't accept termination as is does not comply etc etc" I emailed PHS and they apologised (yes really) for not saying why my letter didn't comply. To be fair I did make a slight date error. The guy said I suggest you re-send the letter with the correct dates which I did. Back came the reply "We can't accept..... &*$+~#! Anyway, square one is a comfortable place, I'm familliar with it having been there so often!
One piece of advice to all, keep every single piece of correspondance as it's so easy to forget things (like they do)

Apparently Peter Cohen is trying to sell this business right now. Hmm.

I'm still waiting for the hearing date. After I have had an order for costs against them, I am going to be pushing the District Judge to make a report to the Ministry of Justice asking them to be put on the vexatious litigants list.

It would mean they would have to make an application to Court before they could bring proceedings.

I am not sure of the proceedings to have someone/business put on the list but judging by the amount of misconceived claims they have brought, and the manner in which they have brought the case I am dealing with it wouldn't surprise me if someone, somewhere, in the MOJ has a file on them....

It would be great to get something like that going if someone had the time and enthusiasm. I'm going to contact my MP Peter Bottomley to see if he's able to help. The PHS depot and offices are just 2 miles from here.
Got my AWTN invoice today, only £237!! I actually worked out today that their charges have increased (taking into account admin charges) by around 700% from the original agreement, that's in less than 2 years. Not bad if you can get away with it!:eek:

"There is normally Duty of Care Charge but we are doing it free of charge for the 12 months, after that you could terminate or call to negotiate new prices.”

Not surprised as we was charged more than we was quoted for the first two months.

I'm in the process of writing a letter claiming that they repay the amount in full.

The more I read the more I realise what a strange company this is. It's such a shame that Trading Standards aren't interested. We have contacted them, in fact I contacted them over another issue with a local garage and it was a waste of time. It makes me wonder what they actually do if anything. If anyone from TS reads these posts perhaps you can tell us all why you do exist!

Another question someone may be able to answer. Two local businesses have their contracts ending in Feb and March but they still have an invoice for £237 for the AWTN. Are they liable for the whole amount or just for the two and three months? PHS of course say they have to pay the full amount, but then they would wouldn't they.

So we sent the letter and an email today and got an email back a few hours later. We have been given 25% off so far...

Unbelievable as we have in writing that we will not need to pay this charge for 12 months.

Quite right. Accepting anything PHS offer amounts to accepting their unfair terms and conditions and gives them another hold on you. As a client said in a letter to my wife's boss (he's a solicitor) "At least Dick Turpin had the decency to wear a mask, you thieving $%*£$!":)

In other words the PHS board of directors want a bigger bonus and this is one way of making sure there's enough in the already large kitty.
I got a letter today from their legal dept telling me my situation is unacceptable! Pot, kettle black...

From what I remember they confirmed that I should contact the environment agency about the spurious 'waste treatment notice' ( the one meant for hazardous waste, and confirmed I could download my own WTN for free.

It's true that it can be downloaded for free but having signed and agreed to the PHS T & C gives them permission to charge for it. What they don't give you any idea of is just how much they'll charge. As I've said before, Rabbit charge £25 so why PHS charge £237 is a mystery.
So what many, me included have done is to sign a contract without understanding the legal jargon and the many implications. So we put our trust in a company hoping they'll be honest and fair. Whoops, what a mistake, we've put our trust in the highwayman of waste disposal!

I'm a previous PHS Wastetech customer and did manage to get out of the contract when we moved premises (see earlier in the thread) . Two questions I've been wondering though:

What's their actual company name or their company number?
Also, are they part of PHS as in PHS washroom services etc?

Quick update.

We had a phone call this morning from PHS saying that they was in the wrong and they are sorry for taking the money from our account. We should not of been charged if we was told it will be free for 12 months.

They have asked for our bank details so they can repay the money back into our account with in 4 days.

Let's hope they do what they say this time...

SamStones: I expect they have lots of separate company names to cover areas different aspects of the business. However the main PLC is PHS GROUP with the reg number 05384799.

They also go under the name of PHS All Clear which I believe is their clinical waste dept. And they are the same PHS that have the washroom service. They have also incorporated other companies into the PHS fold.

I too have recived the above problems with the Annual Waste Transfer Notice. They have charged me £198.00 + vat = £237.60.

I also feel this is well extreme as i only have my 1000Ltr Eurobin emptied once a month at an estimated cost of £10.86 as of when i signed my contract.

According to their terms and conditions i cannot cancel my contract as ive missed out the 3 month rule by a few weeks.

Any help will be appreciated

Unfortunately like the rest of us you find yourself bound by their unfair terms and conditions, you'll soon discover what a fish on a hook feels like!
Can I ask how long you've been with them, and have they charged you for a Pre-Acceptance Audit? My original charge for a 1000L bin was £7.50 once a month. Less than 2 years later over £38! Keep posting on this forum, the more info we all get the easier it will be to fight these robbers.

Hi all just signed up to this forum looking for ways to fight phs ,by the looks of things we are all having the same problem, yesterday i did report them to watchdog via there website, it would be good if as many people as possible could do this as the more complaints to them the better and once watchdog notice a pattern of complaints they may start to look into doing a story!!

On another note i did talk to someone today from The Federation of small businesses who deals with a lot off phs complaints and he basically told me that there contract is worth nothing, as a term called "the red hand rule" states by law any important info on a contract that may be deemed to be unfair must be printed on the front in red letters with a hand pointing towards it, so as for the rolling contract and waste transfer notes act this should all be highlighted!! from the sounds of it phs just like bullying people and making them afraid to go to court,but it seems the law and courts are on our side even with a dodgy phs contract!!
Google the "red hand rule" it could make for interesting reading!!

I only started with them April 2011, not seen anything regarding a Pre-Acceptance Audit.
OK. It's probably because you had the first year with a fixed charge? Once the first year is up they'll get their claws in you and the price will begin to rocket (as you've discovered with the AWTN) Just out of curiosity, did you receive the charge for the AWTN just after it was too late to cancel within their terms?
When you do receive a charge for a Pre-Acceptance Audit, challenge them on it as I did and remind them that it applies to clinical waste (unless that's what you produce of course) If you have a direct debit set up I would cancel it, that way they can't take money from you whenever they feel like it. Also, if you don't pay these trumped up admin charges they eventually offer you discounts if you pay up. Or in my case they took them off alltogether for unknown reasons.
Also, when your prices go up, as they will, ask why they didn't send you a letter notifying you of the increase and then ask for a copy (which they will fabricate) One more thing, keep absolutely everything they send you and copies of everything you send them including emails, it will help you if you should ever face legal action or need to negotiate.

I don't often watch watchdog, but do they usually cover stories that are classed as business to business? ie rather than business to consumers? Don't get me wrong, I would love to see watchdog take these guys on, I just didn't think they'd be interested.

I think they would be interested if enough people contacted them. I've been meaning to do it so this has given me the prompt I need, I'll do it today. Hopefully others will.

This is the problem, we're all (or nearly all) happy with PHS at first. Their collection service was fine. The issue has always been unrealistic price increases re collection and admin, also the unfair contract which needs a trained legal mind to examine, which most of us don't have or can't afford. That's why I said we put our trust in these companies expecting them to behave in a fair and reasonable way which they don't.

Watchdog is not really for business but BBC's Rip off Britain might help , the best way to get someone to expose this company could be through the Daily Mirror and there Investigates section on there website they seem to look into anyone being ripped off.

Good idea. I think we need to try every possibility and always giving links to this and other forums. I can't emphasize enough the importance of keeping every scrap of communication with PHS. My file is now 70mm thick! One of the reasons I say this is because they make lots of mistakes as communication within the company seems poor at best. Mistakes on their part are important should it come to court.
