Hi, I think this may have been covered previously but I have not been successful in finding it.

A competitor is using our photographs in the sale of the same product.

Do we have any legal recourse or do we just have to take it on the chin?

We have asked them via email to remove them but these requests have been ignored.

Thanks

Dave

Sounds like you might need to escalate the complaint/threat of action. I can recommend a solicitor if you can't find one on here.

There are lots of topics on here where people have accidentally used photos they did not have the rights to, and have been hit with large demands. This is the reverse situation - you the aggrieved party, so you could simply do exactly what peope like Getty Images do - submit an invoice for the unapproved use of your photographs, noting the request to remove them has not taken place, and then submit an online claim for IP infringement - which is what Getty do all the time. Pick a price, a steep one, and then offer them a reduced price for not being taken to court.

Send a cease and desist letter for them to remove immediately and report them on the website they are being used on.

Send them an invoice for the costs on unapproved use for each photo they are using. Make sure you take dated screen grabs of where and how they are being used ,
