No Sick Note - do they get SSP?

We have an employee who has been off sick for a few weeks and we have been paying SSP, they have doctors notes covering them up to last Tuesday. On Wednesday they phoned in saying they still didn't feel well and would be off for the rest of the week. I told them to get another sick note to cover the additional 3 days. It doesn't look like they will be getting one.

My question is should they receive SSP for Wed-Fri if they can't produce a sick note?

    Does your sickness absence policy state that they must provide sick notes to cover all absences beyond 7 days? If so then, unless they produce one, you don't have to pay SSP. If you don't have a policy I think you can still refuse to pay it because they have deen producing sick notes and you have reminded them they still need one. Bear in mind it can be difficult to get a sick note and they haven't yet had long to produce it.

    Paying SSP is the minimum that you must pay if all conditions are met. You can still pay it if the conditions are not mewt - it is your choice as it is your cost (you can't reclaim it).

    Thanks Cyndy. I thought that would be the case. Our absence policy clearly states that sick notes are needed beyond 7 days.

    If they produce the sick note after the payday for that week I assume we should just add the SSP to the next weeks payroll?
