New product idea

Hi, I'm after some advice.
I came up with an idea to invent a product which combines 2 products which already exist seperately into one.
I am not sure if such an idea can be patented and what the next step is :|
 
The nuts and bolts of Patents are a bit dry and dusty but two basic concepts are clear.The basic idea is that you can patent something that is new and non-obvious.So you may be able to patent your idea.

However if the owners of the IP for the existing products want to claim that you are simply combining existing (not new) concepts without adding any novelty/uniqueness then you may have a bit of a fight on your hands unless the new product is so innovative that people will see it as a different animal from its 'constituent parts'.Can't think of a helpful example but maybe you've heard the expression "The whole is greater than the sum of he parts"

Not a clear cut answer but perhaps it makes clearer what the basic issues are : How novel will Poduct3 be from Products2+Product3.

Hi

I'm a patent attorney.

A combination of things can be patented if the combination has a 'synergistic effect' and is not a 'mere collocation' (as with the classic sausage machine patent).

That is to say the combination must be greater than the sum of its parts.

That said, if the combination is new it can always be argued it is inventive.
