Hi Guys,
I am sorry my first post is a question but I have been searching the internet for the past 48hrs looking for help and advice and stumbled across this forum. I hope to contribute more in the future. But I require some help/advice.
I have been working for one of the largest Mutuals in the UK for the past 10 months on a temporary contract. In mid October I was told along with a few others they would like to make me permaneant and I agreed, I was never advised of what my salary would be and was told this would be confirmed in writing by HR.
On the 29th of October I received my contract through I checked it through and was happy with everything contained in it. The salary stipulated was £1500 more than I currently earn as a temp. I did not find this an issue and believed that by going temp to perm I would be paid a better wage.
My official transfer date is the 25th of November, I had signed my contract and sent it back on the 30th of October.
On Monday the 11th of November I was made aware of rumours going around the office of unrest in the camp and this was caused by one of the group I was made permaneant with telling someone their starting salary which worked out at more than some of the guys who are already employed here on a perm basis. The outcome of this was investigations were made and it's been briefed out that the HR team made an admin mistake with the contracts.
Yesterday afternoon I was advised that this mistake would be rectified and HR would issue a letter and a new contract and we would have to sign that and start on a salary of £1500 less than the initial salary quoted on the contract. I am obviously peeved off by this as it transpires I will now not earn more as a permaneant employee.
I signed the initial contract in good faith and believe that is binding. I feel under pressure now to accept the new contract as the majority of the group I got made permaneant with are "just glad to be perm" this was the message they gave out at a meeting yesterday with a Senior Ops manager. I obviously disagreed but feel as if I am putting a target on my back.
I spoke to our Union Rep (well the guy who will assume this position once things are formalised and he shares my views but as he is not recognised in the role yet he spoke to another colleague who at first agreed with him but after discussions with HR she has come back and said as the contract has not yet started ie mistake has been rectified before the start date then the company is within their rights to revoke it and issue us with revised terms.
I would welcome any feedback, case law perhaps where this has proven not to be the case.
