need help

hi i need help with the situation i am in. recently our franchisor has forced us to stop trading. he held back on our august money owed to us. the reason being is we got into difficulty paying our suppliers, but we had already made a repayment plan to pay them in writing which they agreed. but because our franchisor is holding our money we can not keep the repayment plan. we have found out today he has sold part of our territory on which the bloke says he is half way through the proces which can take upto three month so this was in progress while we were trading. we have had nothing saying our contract has been terminated. do we have a leg to stand on to take him to court as we have a lot of debt to pay know because of him. also in the last year at least 3 other franchises have been terminated in the same sort of way . any help would be appreciated

Go see a solicitor. Your problem depends on so many things, including the full terms and conditions in the Franchise agreement.

For example the agreement may well have a clause in it that permits them to terminate it if you go into such voluntary agreements.

The Franchisor has a duty to protect the reputation of the overall business. Whilst it may be that in your case they are acting a but hastilly, they may be within the law. Without full details, an accurate answer is unlikely.
