Hello all, I need some advice.

I am looking into creating a surprise toy cup business, which is aimed at kids to open as a surprise. I would hand decorate cups and fill them with toy surprises. The cups and coatings will be BPA free and the toys will be UKCA marked.

My only issue now is that I have a contraption inside my cups which allows for confetti to drop out of the cup. However, to enable this to happen, my contraption consists of card paper, elastic bands and staples. (These contraption parts are obviously meant to be chucked away as its part of the packaging really.) The child would only then keep the cup and the toys.

Is this going to be allowed in my cups? Do I need to address safety concerns, or age restrictions, or is this actually not a possible idea to have.

Go and pay for testing. They will tell you if it passes the required quality standards.

@Mandekinz Please tell us that you are getting professional advice on all the products that you are selling for kids parties. There have been quite few of the 12 years that you have been coming here.
They are not for kids parties. They are just a product I would like to make and sell.

I dont understand what you mean by "there has been quite a few for the 12 yrs ive been here"..??

For goodness sake, all im doing is asking for advice and you are looking back on business ideas i posted from 10 years ago, and I posted very recently about an ONE idea which associates with this one.

But they are for children. Which means they need to be tested and compliant.

I understand, but this is not to do with toys anymore. This is to do with the packaging, Am I supposed to safety test the packaging?

    Unless the packaging is always completely removed before a child comes into contact with it then, obviously, YES

    The cups and toys would already have been tested. I source these from the UK. I am talking about the interior packaging, made of paper card and elastic bands...
    What do you mean by "interior packaging"? Inside the cup? This is part of the product and must be safe.

    The actual packaging of the product must clearly state any risks, e.g., not for children under X years" or "choking hazard", or ... Should also have UKCA marking, if appropriate.
