Hi all,
I shall try to keep this as short as possible but wondered if anyone could help.
I had a license in a shopping mall to operate my own kiosk from.
Due to illness I missed a weeks rent payment but hadn't realised and the account department of the shopping mall hadn't picked up on this missed payment either.
I made numerous payments when suddenly the notified me of the missed week.
After much discussion we agreed the amount owed would be spread over the next few rent payments.
I made the first payment despite slow trading conditions and informed the managing agent we were struggling to get the next together.
They ignored me before deciding I had to get the full amount owed (£500) to them by the end of the day with a paper statement from my bank showing this payment.
I told them this wasn't possible and I was told to close with immediate effect.
After many many emails where they would allow me to reopen one minute then not the next they terminated my license.
The shopping malls management team removed all my stock (damaging it in the process) and removed the custom built kiosk I'm hiring from a friend also damaging this.
They have now told me that unless I get the £500 to them immediately I cannot have my stock back nor can my friend have his stand back.
I asked to inspect my goods and was issued a banning order from the centre that now means I cannot go anywhere near.
Could someone please advise in the legalities of this? My license at no point states they will retain goods and I'm reluctant to pay the £500 until I see the extent of the damages to my stock.
