landlord not giving deposit back

first post here !
wondering if anyone has any advice
we leave our commercial property over 6 weeks ago and havnt received our deposit back !
landlord had us chasing the letting agents for it but they didn't hold it and he has it
LL promising us week after it was getting sorted
we had a LOT of issues too with the unit i regret not taking it further at the time (leaks no electric/cutting out, LL walking through,unfinished work,electric wires hanging out, neighbors issues )the major issue we had is that we were given false infomation when taking the unit on. we provide a service so at the start we lost a lot of customers, hencing we will had to leave
we are start up business and young, we definely see this as he took advantage
we left the unit clean and no damage
i think im going to get legal advice ??

    Welcome to the UKBF sorry to hear about the troubles your having. Did you have a proper lease, not behind with rent and give the correct notice etc and when you did hand the unit back was it inspected either by the agents or landlord and all agreed ok. Hopefully if everything was done an acted upon correctly and you have not left the landlord any excuses not to return your deposit in which case if your still chasing it maybe worth speaking to your original solicitor (if you used one) who advised you on lease .

    The other issues you had with the unit should have been dealt with a the time just concentrate on getting the deposit back now and finding more suitable accommodation

    The deposit should have been paid in a special deposit account.

    The landlord should not be holding it personally.


    Your best bet might be to threaten to report the landlord, but ultimately if there is no third party holding the deposit, you would have to take them to court. https://www.gov.uk/make-court-claim-for-money

    I believe this only applies to domestic rentals. Commercial leases have different rules.

    Oh, thank you for pointing out my error! I'm sorry I misread the post and thought this was a residential deposit.
